1. WHAT IS IN THIS NOTICE?

At The For Baby’s Sake Trust we operate with openness, honesty, integrity and in compliance with the law.  We are committed to protecting your personal information and being transparent about what we do with it. 

This Privacy Notice sets out how we collect and use your personal data via the For Baby’s Sake App and how we keep it private and secure in accordance with data protection regulations – The Data Protection, Privacy and Electronic Communications Regulation 2019 (UK GDPR), the Data Protection Act 2018 (DPA 2018) and the General Data Protection Regulation 2018 (EU GDPR).

The For Baby’s Sake Trust has an overarching Privacy Notice covering our wider data processing activities (https://forbabyssake.org.uk/privacy/).  This separate and specific Privacy Notice covers only the For Baby’s Sake App and sets out:

  • What information we might collect about you
  • How we might use that information
  • What information we might share with others, covering information that is directly or indirectly identifiable information
  • Your rights about the personal information we process

2. WHO ARE WE?

The For Baby’s Sake Trust is a charity that aims to protect infants at risk and voiceless, break cycles of domestic abuse, intergenerational trauma and poor outcomes and act as a catalyst for change, getting to the root of complex challenges and breaking new ground.  We amplify our impact by sharing our innovative learning and working with others to influence practice, policies and systems. 

We are registered in England and Wales under company number 6713945 and charity number 1126459 and have our registered office at 4 Meadway Court, Rutherford Close, Stevenage SG1 2EF.  We are the ‘controller’ of the processing of certain data for the purposes of UK data protection legislation.

This Privacy Notice, together with the For Baby’s Sake App Terms & Conditions, will inform you as to how we may collect and use the information you provide through the App and tell you about your privacy rights.

Please read the following carefully to understand how we will treat your personal data.

3. THIRD PARTY LINKS

The App may, from time to time, contain links to and from websites of third parties, especially where they have resources that we believe would be useful for users of our App.

This Privacy Notice does not apply to the practices of any third parties that we do not own or control, such as third party websites that you choose to access through the App.  While we attempt to provide access only to third party services that share our respect for privacy, we cannot take responsibility for such third parties.  We advise you to check their privacy policies before providing your information to them.

4. INFORMATION WE MAY COLLECT FROM YOU

‘Personal data’ or ‘personal information’ means any information relating to an identifiable individual.  It does not include data where the identity of who it belongs to is not known (anonymous data).

We may collect, use, store and transfer different kinds of personal data which we have grouped together as follows:

  • Child profile data includes information about For Baby’s Sake babies, such as their name, gender and due date and images.  Where you upload such information, you confirm that you are consenting on the baby’s behalf to such sharing, as their parent or legal guardian
  • Contact data includes email address, postal address, telephone and/or mobile number
  • Identify data includes first name, last name, date of birth and gender
  • Image data in the form of photographs or other images that you upload to the App
  • Location data includes location information that you choose to share with us
  • Profile data feedback and survey responses, information about your progress through the For Baby’s Sake programme, including number of sessions completed with your practitioner, resources used etc
  • Search data comprises information requested in in-App searches
  • Sensitive (or ‘special category’) data includes physical or mental health or condition
  • Survey data includes information which you provide to us by completing surveys or polls
  • Technical data includes internet protocol (IP) address, your login data and operating system
  • Usage data includes information about how you use the For Baby’s Sake App. This is statistical data so that we can look at how you use the App and how we can make it better, and which allows us to carry out statistical research to analyse information to identify trends or patterns to help us improve our support to parents, their babies and families
  • Cookies are small files containing a line of text that may be sent and stored on your computer when you visit a website.  Cookies help to provide a better and faster experience by helping a website remember information about your visit to make your next visit easier and the site more useful to you.  For more information on the use of cookies on the For Baby’s Sake App, please email app@forbabyssake.org.uk

The provision of personal data to us is not a statutory or contractual requirement, or a requirement necessary to enter into a contract with us.  You are not obliged to provide personal data to us.  However, if you choose to use the App, certain personal data as described above will be collected and, without it, it may hinder our ability to provide services to you.

5. WHAT WE MIGHT DO WITH THAT INFORMATION

We process personal information through the For Baby’s Sake App for the following purposes:

  • To ensure that The For Baby’s Sake Trust meets its data protection obligations in relation to how personal information is processed
  • To demonstrate that we are accountable for such processing in accordance with UK GDPR and Data Protection Act 2018
  • To support our broad charitable aims and objectives and ensure that those engaged in the Trust’s For Baby’s Sake programme as service users and who choose to access the App are provided with the best possible service and support as efficiently as possible
  • To safeguard those engaged in For Baby’s Sake, their families and any other individuals should we judge they may be at risk
  • To set appropriate systems and controls according to our technical and organisational standards
  • To ensure data protection is built into the design of new projects which include the processing of data, so that data privacy is evidenced by default
  • To safeguard staff and stakeholder interests

6. WHERE WE STORE YOUR INFORMATION

All personal information is stored securely within the United Kingdom.

7. FOR HOW LONG DO WE KEEP YOUR INFORMATION

We will only use and store information for as long as necessary for the purposes it was collected for, and to meet any legal, regulatory or operational requirement.  For example, for those engaged in For Baby’s Sake as a service user, how long your and your child(ren)’s data will be kept for will take into account the retention periods in use in your local authority area, which may include:

  • Up to 15 years for those accessing family support services
  • 15 years after the closure of a Child in Need case by children’s social care
  • 50 years from the disclosure of a child protection or safeguarding concern that has been investigated by social care

How long we keep your records will also depend on the agreement we have made to contact you in future to find out about the difference the For Baby’s Sake programme continues to make for you and your family over the longer term.

8. DISCLOSURE OF YOUR INFORMATION

We may need to share your personal information with others from time to time, including:

  • As is necessary and appropriate in order to protect and support you, your co-parent and child(ren) and when there is a clear and legitimate purpose to do so.  Your For Baby’s Sake Practitioner will take you through this process and will make sure that you know who they may share information with and for what purpose whenever possible.
  • If we are required to do so by law, a regulator a law enforcement agency, or in order to enforce or apply our App Terms and other agreements
  • Our service providers who operate the App, or provide and support our management and data storage systems
  • With our professional advisers, such as our accounting and legal advisers where they require information in order to provide advice to us

We will keep your personal information confidential and, where we do provide it to other third parties as outlined above, we will only do so under terms specifically agreed with them, on conditions of confidentiality and security, and only for the purposes for which you have provided your information to us.  We will never sell your personal data. 

9. PERSONAL INFORMATION RELATING TO CHILDREN AND MINORS

In most cases, For Baby’s Sake App users have young babies and children under the age of 13 years and will be asked to consent for gathering and sharing information on their behalf.  However, should you have a child or children over the age of 13 who will be engaged in For Baby’s Sake, they may be asked to give their own informed consent to us gathering and sharing their information.

10. YOUR RIGHTS

We want to ensure you remain in control of your personal data.  Part of this is making sure you understand your legal rights, which include the right to:

  • Access your personal information (known as a ‘subject access request’);
  • Object to processing of your personal information;
  • Object to automated decision-making and profiling;
  • Restrict the processing of your personal information;
  • Portability of your personal data;
  • Correction of your personal information; and
  • Erasure of your personal information

Please keep in mind that not all of the rights listed above are absolute and, though we will always try to respond to your satisfaction, there may be situations where we are unable to do so.

Whilst you do not have to use it, if you wish to request a copy of the information we hold about you, we can provide a template subject access request form which includes guidance on how to make your request (and should help us respond more quickly).  We won’t charge an administration fee for considering and/or complying with any requests to exercise your rights, unless we believe the request is excessive in nature.  If we are unable to fulfill your request for any reason, we will provide you with the reason why.

12. CHANGES TO THIS PRIVACY POLICY We’ll amend this For Baby’s Sake App Privacy Notice from time to time to ensure it remains up to date and accurately reflects how and why we use your personal data.  The current version of our privacy notice will always be posted on our website.  This
